Draft Planning Agreements Policy

Lane Cove Council is seeking community feedback on its Draft Planning Agreements Policy, which sets out a clear, transparent and accountable framework for how Council negotiates, prepares and administers planning agreements with developers.

What is a planning agreement?

A planning agreement is a voluntary, legally binding agreement between Council and a developer, linked to a development application or change to planning controls. Under these agreements, developers commit to providing public benefits - such as land dedication, community facilities, open space, affordable housing or monetary contributions - in exchange for development approval.

Why is this policy important?

This policy establishes the rules and principles that guide how Council approaches planning agreements on behalf of the Lane Cove community. It ensures that any benefits secured through the planning agreement process are genuinely in the public interest, proportionate to the scale of development, and consistent with Lane Cove's broader strategic priorities.

The Draft Policy sets out:

• The principles and governance framework Council applies when considering a planning agreement
• When and how Council will negotiate with developers
• The process for assessing, exhibiting and finalising agreements
• Probity requirements to ensure fairness, transparency and accountability throughout

How to have your say

Council invites residents, businesses, developers and community organisations to review the Draft Planning Agreements Policy and share their feedback. Submissions close 21 July 2026.
